Jason Wagner is the founding member of Wagner Law, PLLC and a native Texan. He started his own law firm to ensure that his national, state-wide, and local clients received the best legal representation in the most efficient and cost-effective way possible. When handling a litigation matter, Jason approaches the case in a collaborative manner with the client to ensure the most favorable outcome by providing representation specifically tailored to the needs of the particular matter. When matters do not involve lawsuits, he works closely with his client to focus on the key issues that need resolution so that they can be achieved promptly and efficiently.
His civil litigation practice involves all aspects of case preparation, including pre-suit investigations, discovery, depositions, motions practice, briefing, trial preparation and participation, and appellate representation. His civil litigation experience includes handling hundreds of matters in multiple state and federal jurisdictions, involving a variety of allegations, ranging from premises liability and negligent security to commercial litigation to employment matters to construction claims to administrative disputes to products liability, among others. These cases involve serious personal injuries ranging from allegations of wrongful death to debilitating and devastating personal injuries and often involve complex facts and scenarios, as well as aggressive and well-funded opposition.
He obtained his Bachelor of Science degree, summa cum laude, in Political Science from the University of Houston in 1992. Jason then spent three years in Washington, D.C., where he received his law degree from Georgetown University Law Center in 1995.
After law school, Jason returned back to Texas and began his practice in civil litigation with various Houston-based and regional law firms. While representing his clients in state and federal court, he honed his litigation skills in various practice areas, including civil litigation, products liability litigation, commercial litigation, insurance defense, personal injury, labor and employment law, general litigation, premises liability, administrative law, and wills and probate law.
Throughout his career, Jason demonstrated an extraordinary ability to obtain successful results in litigation matters at all levels of practice, including in the following appellate cases:
Secured a summary judgment for multiple parties based upon independent contractor liability and Chapter 95 of the Texas Civil Practice and Remedies Code, with an affirmance by the Fourteenth Court of Appeals [Bartee v. Baylor College of Medicine, et al.]
Obtained dismissal of medical device-based products liability claim at early stages of litigation, with an affirmance by the Eleventh Court of Appeals [Copeland v. Medline Industries, Inc.]
Successfully appealed denial of motion to transfer venue for multiple defendants in toxic tort benzene litigation to Ninth Court of Appeals [Union Carbide Corp. v. Loftin]
Avoided equitable expansion of product liability statute of repose in serious personal injury federal court litigation, with affirmance by the United States Court of Appeals for the Fifth Circuit [Dalfrey v. Boss Hoss Cycles, Inc.]
